By using the First Light Couriers PTY LTD services, the client agrees to the following terms:
4.1 The Client undertakes not to tender for transport, without the prior written approval of the Company, any goods likely to cause damage including, but not limited to any dangerous, noxious, corrosive, inflammable or explosive article, or substance or any article or substance likely to cause injury, infection, or to encourage vermin.
4.2 If the Company accepts under special arrangements previously made in writing, any goods of a dangerous or hazardous nature, the Client warrants that such dangerous or hazardous goods shall be accompanied by the necessary declarations so required. Such packaging, warning labels and declarations shall in no way exempt the Client from the requirements of the relative legislation and regulations, nor from any liability due to damages caused to any one in and during the handling and transport of such goods. The Client indemnifies the Company or any third party or subcontractor against any loss, damage or claims by third parties arising from loss or damage caused by such dangerous or hazardous goods.
4.3 If such goods are accepted under arrangements previously made in writing or alternatively if the Client, for any reason whatsoever, did not reveal that the contents of any parcel or container is dangerous, hazardous or of an offensive nature, at its sole discretions. The Company shall not be liable to the Client for the value or loss of such goods or parcel and shall be entitled to claim from the Client the reasonable costs for dealing with such goods.
4.4 The Client shall avoid tendering to the Company parcels containing exceptionally fragile items such as glass, glassware, mirrors, pottery, crockery, china, cast cement, plaster or asbestos finished or partly finished products or goods or any other similar or allied goods of a fragile nature or valuable item such as bullion, coins, precious stones, jewellery, valuable antiques, pictures, bank notes, securities, other valuable documents or articles, livestock and plants. If the Client does tender such items, he shall be obliged to pack and label such goods so as to minimize the additional risks to which such goods may be exposed.
4.5 The Company shall not in any circumstances be liable for any loss or damage whatsoever caused by the hazardous, perishable, fragile or brittle nature of goods, nor for mechanical derangement of the goods.
4.6 The Client warrants that goods tendered to the Company are adequately packed and prepared for transport.
4.7 The Company shall not in any circumstances be liable for the scratching, cracking, denting, chipping, bruising or breakage or other loss or damage to inadequately packed goods handed to the Company for transport.
4.8 The Client holds the Company harmless from any consequences arising from the Client’s failure to observe the terms of this clause (4.1-4.7).
